"content": "(ii) The Government invoked Section 74 of the Public Procurement and Disposal Act, 2005 to procure services of M/s Intertek International Limited. The Act allows procuring entities to make direct procurements and it states inter alia, if, there is an urgent need for goods, works and services being procured; the circumstances that give rise to the urgency were not foreseeable and were not the result of dilatory conduct on the part of the procuring entity; and the other procurement methods are impracticable. Mr. Deputy Speaker, Sir, Section 90(2) of the Act further allows direct procurement of goods, works or services from a reputable provider in respect of low value goods or services that fall far below a threshold of Kshs30,000. The criteria and procedure used to engage the services of M/s Intertek to undertake tests on maize imported into the country from South Africa was, therefore, lawful. (b)The amount of money paid to the firm for conducting tests was Kshs25, 520 broken down as follows:- Analysis costs - Kshs17, 000 Sampling"
