I beg to move: THAT, Clause 4 of the Bill be amended by deleting paragraphs (a), (b) and (c) and substituting therefor the following new paragraphs— (a) permit altruistic surrogacy; (b) prohibit commercial surrogacy; and, (c) make consequential provisions thereto. I am proposing the deletion of paragraphs (a), (b) and (c) because they are vague. I propose they be substituted with the new (a), (b), and (c). In (a), I am proposing that the object of the Act permits altruistic surrogacy. Members will later see how I am defining altruistic surrogacy in clause 2 when we deal with it. Clause (b) is to prohibit commercial surrogacy, and clause (c) is to make consequential provisions thereto. Altruistic surrogacy is where a person is not paid or does not have financial gain in the process, in terms of hiring a womb and such like things to carry a pregnancy to term. Commercial surrogacy has been prohibited across the world, and I have before me the Convention on Human Rights and Biomedicine. Article 21 states that the human body and its parts shall not, as such, give rise to financial gain. We are signatories to the Convention. I am simply making it specific that we will allow altruistic, or what in Kenya we call traditional surrogacy, where a woman is helped to carry pregnancy to term, but the person carrying the pregnancy is not paid on commercial terms."
