Temporary Chairlady, I beg to move: THAT, Clause 27 of the Bill be amended in the proposed new section 177 in subsection (1)(a)(i) by deleting the words “not less than” appearing immediately after the words “a term of” and substituting therefor the words “not exceeding”. This amendment seeks to rationalise the penal provision for a natural person and to make it commensurate to the offence. Section 177(a)(i) states that a natural person shall be liable, upon conviction, to a fine not exceeding Ksh1 million or to imprisonment for a term of not less than 10 years, or to both. This amendment changes ‘for a term of not less than’ and substitutes therefor ‘not exceeding’. This is not just in line with good legal drafting but also seeks to provide that the penal provision for a natural person is commensurate to the offence that may have been committed."
