The ruling states that under the Political Parties Act, you cannot be a member of a political party because you are not a Member of Parliament and yet, the Constitution of Kenya, which is more supreme, states that the Speaker is an ex-officio Member of Parliament. Therefore, the rights that a Member of Parliament enjoys are the same rights the Speaker enjoys. The Speaker can belong to a party."
