    "content": "I will quickly now go onto the legal issues. I will leave the other observations because there were many other witnesses that gave evidence and I do not want to read all that. There were certain legal issues that the Committee noted. The first issue was that, should the CBK have proceeded to sell the hotel by way of exercise of its statutory power of sale or should it have first transferred the hotel to itself and thereafter dispose of the hotel in accordance with the provisions of the Procurement Act? The Committee observed that by way of transferring the hotel to itself first and thereafter disposing of the same, that would have given transparency to the transaction and I think it would probably have led to higher proceeds for the Government and for the people of Kenya."
