    "content": "Mr. Temporary Deputy Chairman, Sir, I beg to move:- THAT, Clause 31 of the Bill be amended - (a) in the proposed new section 83R by inserting the words \"in consultation with the Commission\" immediately after the word \"Minister\"; (b) in the proposed new section 83S by renumbering the existing paragraph (a) of the proposed subsection (1) as paragraph (b) and inserting a new paragraph (a) as follows - (a) the effective delivery of public goods and services; improving quality of life for disadvantaged communities; strengthening good governance and public participation; creation of a better business environment; improving productivity and efficiency of government departments; (c) in the proposed new section 83W by deleting the words \"two hundred thousand shillings or to imprisonment for a term not exceeding two years\" appearing in paragraph (a) of the proposed subsection (2) and substituting therefor the words \"five hundred thousand shillings or to imprisonment for a term not exceeding three years\"; (d) in the proposed new section 83X by deleting the words \"two hundred thousand 4048 PARLIAMENTARY DEBATES December 10, 2008 shillings or to imprisonment for a term not exceeding two years\" appearing in the proposed subsection (1) and substituting therefor the words \"five hundred thousand shillings or to imprisonment for a term not exceeding three years\"; (e) in the proposed new section 84B by deleting the word \"two\" and substituting therefor the word \"three\"; (f) in the proposed new section 84G by deleting the words \"three hundred thousand shillings or to imprisonment for a term not exceeding three years\" appearing in subsection (2) and substituting therefor the words \"one million shillings and to imprisonment for a term not exceeding five years\"; (g) in the proposed new section 84W by inserting the following new subsections - (4) The Commission may, by notice in the Gazette, declare a person or institution to be `a major telecommunication service provider' for the purposes of this Act. (5) In making a declaration under subsection (4), the Commission shall consider- (a) the market share of the telecommunications service provider being at least 25 five percent of the total revenue of the entire telecommunications market; (b) the level of control over the communications infrastructure; (c) the level of technological advancement of the telecommunications service provider; (d) the scale of operations of the telecommunications service provider."
