You will note that Clause 39 says:- \"If the Commission considers it reasonably possible that a complaint may be conciliated successfully, the Commission shall refer the complaint to the Commission Secretary\". The power in this Act is to the Commission and the Secretary is an employee of the Commission. So, all I am suggesting that, it should read:- \"The Commission shall refer the complaint--\""
