All that was needed of me was to produce evidence that the contractor had paid the sub-contractor and that the sub-contractor paid the employees. Regrettably, I have a schedule of the contractor paying the sub-contractor, but there is no evidence that the sub-contractor paid the employees. So, on that basis, I have instructed the Commissioner of Labour to go to Mombasa and find out the situation on the ground. Otherwise, evidence of payment of the contractor to the sub-contractor is available here."
