"content": " Mr. Temporary Deputy Chairman, Sir, I beg to move:- THAT, Subsection 23(4) which was deleted by the National Assembly be re- inserted and amended as follows- (4) The provisions of the Criminal Procedure Code, the Evidence Act, the Police Act and any other law conferring on the police the powers, privileges and immunities necessary or expedient for the detection, prevention and investigation of offences shall, so far as they are not inconsistent with the provisions of this Act, apply to the Director and an investigator as if reference in those provisions to a police station, police office or a police officer included reference to the Commission's premises and the Director or an investigator. Mr. Temporary Deputy Chairman, Sir, in effect, this is, more or less, the same clause that was deleted. But what the President has done is to remove that, so that KACC could also be vested with prosecutorial powers. I think the President was right in so recommending the removal of prosecutorial powers, which are vested, of course, in the Attorney-General of the Republic of Kenya!"
