"content": "Mr. Deputy Speaker, Sir, I thank you. I also thank Mr. Osundwa for his comment about the Speaker being an advocate of long-standing. Indeed, that is why I need to draw the hon. Member's attention to the Constitution. The whole function involving appointments of judges to the Judiciary is that of the President, who acts on the advice of the Judicial Service Commission. Section 68(2) of the Constitution provides as follows:- \"In the exercise of its functions under this Constitution, the Commission - which is the Judicial Service Commission - shall not be subject to the direction or control of any other person or authority.\" Clearly, the interpretation here, as the hon. Member seeks to have, in terms of cancellation of the swearing-in ceremony or appointments, and whether the names of these judicial officers May 17, 2007 PARLIAMENTARY DEBATES 1441 names were entered into the Register of Judges as per the traditions of the High Court, is that it all interferes with the due process of the Judicial Service Commission.
