"content": "It cannot be taken away in any form or guise, whether through a Commission or otherwise. In exercising the right to scrutinise, investigate and bring the Executive to account, Departmental Committees must strictly act in accordance with their mandates as set out in Standing Order No.151 and the schedule to the Standing Orders. They are not ad hoc Committees. Therefore, their mandate is limited to the Ministries and Departments listed under them in the schedule aforesaid. Their role, in my considered view, is limited to scrutinising and to bring to account only those officers in their line Ministries. Their recommendations are to the House which may or may not accept them. Once the House has accepted the said recommendations, it is the role of the Executive to implement them. Parliament does not execute. It is also not a police department to enforce the various acts that create criminal offences. That is the realm of the Executive arm of Government. We must be very careful not to cloud our rules. No arm of Government in my view has a right to assume the role of the other. To the extent, therefore, that the Committees perform their oversight roles in accordance with the Standing Orders, their operations are legitimate and constitutional."
