"content": "Mr. Speaker: Hon. Members, I now wish to make two communications. First, as you will recall, at the sitting of the House held this morning, Wednesday, 21st December, 2011, the hon. Member for Gem, Mr. Jakoyo Midiwo, rose on a point of order on the matter of the defeat by the House at the afternoon sitting of yesterday, Tuesday, 20th December, 2011, of the Motion by the Departmental Committee on Justice and Legal Affairs. The Motion by the Departmental Committee on Justice and Legal Affairs was to the effect that âThis House adopts the Report of the Departmental Committee on Justice and Legal Affairs on the rejection of the proposed nominees to the positions of chairperson and members of the Ethics and Anti-Corruption Commission laid on the Table of the House on Wednesday 14th December, 2011.â In his point of order, hon. Midiwo stated that by law, the nominees are required to be approved by the House. In the instant matter, hon. Midiwo took the view that the rejection of the Motion did not amount to an approval of the nominees by the National Assembly and did not satisfy the constitutional and statutory requirements for approval by the National Assembly. In his view, by the rejection of the Motion by the Departmental Committee, the nominees stood nominated by the Executive, but had yet to be approved by the House. Hon. Midiwo suggested that the names of the nominees will, therefore, require to be returned to the nominating authorities for resubmission to Parliament for vetting by the Committee and subsequent tabling in the House."
