"content": "THAT, the following new clause be inserted immediately after Clause 30- 30A. (1) A state officer commits an offence if that state officer:- (a) Opens, operates or maintains a bank account in a foreign country; or (b) Opens, operates or maintains a bank account in a foreign country through nominees, agents or business associates (2) Subsection (1) shall not apply to bank accounts opened, maintained or operated by state officers who work in diplomatic missions abroad or those authorized to be on study leave or official business outside the country, or in any other case provided for in an Act of Parliament. (3) In addition to any penalty imposed under sub-section (1), the court shall order repatriation of monies held in such account to Kenya. Madam Temporary Deputy Chairlady, if I could just do some explanation; you realize we had said that all the offences that were indicated earlier, the majority of them were already contained in the other Act, but this was a new thing brought in by the new Constitution. It is the new Constitution that brought in the issue of state officers not having accounts in foreign countries. We are creating an offence, so that we provide the incentives for state officers not to do that, and if they have done it, to bring back their money. So, the idea is to create that offence, so that such accounts are closed."
