    "content": "Madam Temporary Deputy Speaker, it is also important to mention that I am a bit disturbed that this Bill has a lot of provisions which I feel are contrary to the provisions of the Constitution. I want to mention three instances. The first one is the issue of public participation and the role of Parliament in the budget making process. If you look at Article 221(5) of the Constitution, it puts it very clearly that once the Executive arm of the Government has come up with estimates of revenue and expenditure, those should be submitted to Parliament two months before the end of the financial year. It is the responsibility of this Parliament to then go outside and listen to the presentations from the people of Kenya. This is captured very well in Article 221(5). It is about discussing and reviewing the estimates. However, let me mention Article 221(4) which says:-“Before the National Assembly considers the estimates of revenue and expenditure, a committee of the Assembly shall discuss and review the estimates and make recommendations to the Assembly.” (5) Goes on to say: “In discussing and reviewing the estimates, the committee shall seek representations from the public and the recommendations shall be taken into account when the committee makes its recommendations to the National Assembly.” So, constitutionally, it is the responsibility of the National Assembly, through its committee, to go and seek representation from the people of Kenya. The Bill attempts to take that away from the National Assembly and gives it to the Cabinet Secretary. Most"
