The Chair has upon further and closer scrutiny of the Public Financial Management Bill, 2012 realized that is not the only debate on Clause 109 of the Bill that raises the issues of constitutionality, but Clause 110 of the Bill that empowers the county executive committee to establish the county governments emergency funds and Clauses 111, 112, 113, 114 and 115 provide for the management of the emergency funds by the county governments executive committees which are in effect implementing the provisions of Article 207(4) of the Constitution. The same can be said of Clause 116 of the Bill that empowers the county executive committee, with the approval of the county assembly, to establish other county public funds."
