"content": "(c) According to the Mining Act, Cap. 306 of the Laws of Kenya, all minerals are vested in the State which holds them on behalf of the citizens. However, the Mining Act requires that consent be sought from the land owner before prospecting and mining activities may be sanctioned. The law also provides for compensation of land owners in case of any damage to the property or degradation of land which has taken part in the course of prospecting and mining. The Government is in the process of finalizing a new Minerals and Mining Bill which addresses the issue of benefit sharing of any revenue accruing from the extraction of mineral resources."
