I would like to inform my colleague that the Executive is still operating under the former Constitution. The powers of the President were saved and the particular paragraph that is relevant to this matter is under Section 24 of the former Constitution. It reads:- “Subject to this Constitution and any other law, the powers of constituting and abolishing offices for the Republic of Kenya; of making appointments to any such office and terminating any such appointment, shall vest in the President.”"
