My learned junior from Githunguri Constituency asked me about compliance and I did say, and I think perhaps he was consulting with my other learned junior, Mrs. Odhiambo-Mabona. I said that this is a judgment incapable of obedience. I did not say we will not respect the court order. That is standard language that any good lawyer who goes on appeal uses in indicting a judgment. And any good lawyer like Olago Oluoch here will tell you that a judgment incapable of obedience is not an assault on the Judiciary. It never will be! As to whether the Executive was negligent in handling this matter or not – and this comes to the point raised by Mr. C. Kilonzo – Mr. Deputy Speaker, Sir, the Attorney-General has indicated that he is not satisfied in the manner that the case was handled in the first place. He has filed an appeal and I have no doubt that he has a good chance on the law, because the law is very clear on this matter. Mr. Deputy Speaker, Sir, hon. Olago Oluoch has said it very clear – and I agree with him – and I want to beg the Chief Justice, my own teacher, that if he makes statements on a case that he is likely to sit on appeal, it can easily embarrass him because this matter will likely go to the Court of Appeal and end up in the Supreme Court, where the Chief Justice is the President."
