"content": "On a point of order, Madam Temporary Deputy Chairlady. Let me read the Constitution for hon. Khalwale. Article 95(5) on the functions of the National Assembly says: “The National Assembly – (a) reviews the conduct in office of the President, the Deputy President and other State officers and initiates the process of removing them from office; and (b) exercises oversight of State organs.” Period. It does not say: “Exercises oversight of a State organ to this extent.” It is primary; “Exercises oversight of State organs.” Now, in terms of operations, you can come and say before the committee: “These are operational issues.” I have no problem looking through the Standing Orders for a specialized organ, as the Minister has said. But hon. Khalwale must note that we cannot legislate to amend the Constitution. We cannot limit powers given by the Constitution to the National Assembly through an Act of Parliament, especially when that Bill has been produced by the Executive. The Executive cannot decide how Parliament runs its business. From the start, Parliament is the one that decides how to run its business. You are the Chair of a very important Committee and if you were to legislate what you want us to legislate for this institution, what about the other institutions that you oversight? You would have no role. All of them would want to limit your powers."
