However, I am afraid the rule with respect to sub judice does not draw a distinction between who goes to court; whether it is the Minister in his official capacity or private capacity. As long as it is in court on a matter that is now intended to be before Parliament, it is subjudice. That dichotomy is not recognized by our Standing Orders. So, if there is appeal and that is a matter of public notoriety, it will remain sub judice until the appeal is determined. Minister, you are accordingly guided."
