"content": "Olenguruone home backyard during 2001 July and discovered the decomposed and dismembered human skeleton to be that of the serviceman. The body was taken for forensic analysis at the City Mortuary and the Government Pathologist failed to identify the decomposed body and did not ascertain the cause of death. It was reported that Molo police released the prime suspect. The corpse is still in the City Mortuary. Mr. Temporary Deputy Speaker, Sir, in the circumstances, it is not possible to conclude that the corpse found was that of Senior Sergeant Silas Biwott Ruto since it has not been authoritatively identified yet. (b) My Ministry does not know where the remains of the serviceman are placed since the corpse has not yet been positively identified as his. On positive identification, the human remains will be handed over to the bona fide family members for a full military burial with honours. Mr. Temporary Deputy Speaker, Sir, in April 2007, we recommended to his family to consider a positive identification of the human remains by DNA method as it is more accurate than that of postmortem determination but this has not yet been done. Because the family delayed to do the DNA test, my Ministry has now decided to take up the matter to fund the DNA testing in order to identify the human remains. In case, the remains are confirmed to be that of the serviceman, he will be accorded a military burial with honours. (c) The serviceman has not yet been declared dead and, therefore, his death benefits cannot be paid. However, should the DNA return positive results as to identify the corpse as that of the missing serviceman, my Ministry will prepare and process his death benefits to be paid to his bona fide family members as provided by the military regulations."
