"content": "Fair enough, Member for Naivasha. I do not see why you should be having difficulties because the Standing Orders provide for how you should proceed. Perhaps, just for purposes of re-emphasis, what the Committee ought to do when it requires any public officer or citizen to appear before it to give evidence--- The first thing that you would do is to invite the concerned witness to appear before the Committee. You invite by a letter. If the person fails to appear before the Committee and, maybe, offers an explanation such as the reasons for their inability, then you again invite them on a date that is mutually convenient to appear before the Committee. If they fail to appear the second time, then you are at liberty to request for issuance of summons pursuant to the Powers and Privileges Act which is Cap.6 of the Laws of Kenya. If there is then failure, the law is clear on what happens next. That is because that person then will be guilty of a criminal offence liable to be arrested and prosecuted before a court of law. So, those are the steps that you must take. Mr. Mututho, have you noted that?"
