    "content": "Mr. Temporary Deputy Chairman, Sir, I beg to move:- THAT, the Bill be amended in Clause 2 by- (a) inserting the following new definitions in proper alphabetical sequence- “accredited consumer organization” means society registered under the Societies Act, Cap.108, Laws of Kenya, for the purposes of consumer protection and related matters;” “Cabinet Secretary” means the Cabinet Secretary for the time being responsible for matters relating to trade and industry. (b) deleting the definition of the word “consumer” and substituting therefor the following new definition- “consumer” means- (a) a person to who particular goods or services are marketed in the ordinary course of the supplier’s business; (b) a person who has entered into a transaction with a supplier in the ordinary course of the supplier’s business, unless the transaction is exempt from the application of this Act; (c) a user of particular goods or a recipient or beneficiary of particular services, irrespective of whether that user, recipient or beneficiary was a party to a transaction concerning the supply of those particular goods and services; and, (d) a franchisee in terms of a franchise agreement, to the extent applicable in terms of this Act.” The justification is that this will define the threshold of consumer organization, so as to avoid ambiguities of every group purporting to be representing consumer interests."
