"content": "On a point of order, Mr. Deputy Speaker, Sir. I think I need to clarify on record that hon. Mwau is misrepresenting me. I am not saying that the President sets the term. It is the Constitution that sets the term; putting it in a layman’s language, Article 171 basically states the term for the JSC. It says that members of the JSC shall serve for five years, except---; then it goes to the transitional clauses which talk about the exceptions. The exceptions talk about one person appointed by the President at his discretion; he appoints two. It is for him to decide which one will serve three years and which one is to serve five years. That is what this is saying in simple terms. That is as far as the discretion goes; that is what I read. Actually it says one of the members appointed by the President under Article 171(4)(h) will be identified by him. That gives discretion."
