I want to take you back, if I may say so, to Article 186(2), so that you can see that the constitutionality here can only arise section by section, clause by clause, but not the entire Bill. You cannot lock the country out of the entire Bill. What you can do is lock out particular clauses. Article 186(2), and this is very important, says that:- “A function or power that is conferred on more than one level of government is a function or power within the concurrent jurisdiction of each of those levels of government”. Therefore, you cannot lock out the national Government from having this law."
