"content": "Hon. Speaker, Sir, the Committee was guided by the provisions of the Public Appointments (Parliamentary Approval) Act, 2011, while undertaking its mandate. On 1st May, 2013, the Committee, through an advertisement in the Press, invited the public to submit memoranda on the suitability or otherwise of the nominees to hold public office in accordance with the provisions of Section 6(9) of the Public Appointments (Parliamentary Approval) Act, 2011. The law provides for public participation within seven days of the receipt of notification of nomination from the appointing authority. Public participation as stipulated in the Public Appointments (Parliamentary Approval) Act, 2011, is in form of submission of sworn affidavits. In seeking public participation, the National Assembly published in the national daily newspapers invitations for the members of public to make submission in form of sworn affidavits on the suitability of Cabinet Secretaries nominees. As a result, memoranda were received in respect of the following nominees, namely Prof. Jacob Kaimenya, Eng. M.S. Kamau, Hon. Charity Ngilu, Dr. Fred MatiangâI, Mr. Davis Chirchir, Ms. Phyllis Jepkoskei Kipkingor Kandie and hon. Najib Balala. These were submissions in sworn affidavits against the nominees that I have indicated. In the interest of justice and fairness, the Committee wrote to the concerned nominees, forwarding the details of memoranda received against them and requested them to respond to the allegations. The Committee received sworn affidavits from all the concerned nominees. The Committee carefully considered the petitions and asked the concerned nominees to provide verbal explanations. Questions were filed to each nominee when he or she appeared before the Committee. After careful consideration of the facts before it, the Committee arrived at the findings recorded in its report. On 3rd May, 2013, the Committee wrote to the Kenya Revenue Authority, the Ethics and Anti-Corruption Commission and the Higher Education Loans Board.
