"content": "Kenya. But that sovereign power is delegated to one of the institutions called âParliamentâ. So, therefore, whatever we exercise here today is a delegated power. The other one is constitutionality. Now, if you ask me about public participation, I think we need to address it much better in future. If you look at the interviews that were conducted at KICC, I felt that public participation was not given enough attention. The fact that there were a few affidavits--- Let us not make public participation so difficult and expensive. By insisting that members of the public can only bring an affidavit; have to go to the lawyers--- We need to flex this. We should make it a bit more flexible for members of the public to give their opinion on the nominees of the Executive. In terms of constitutionality, a lot has been said about it. But I think it is important that we address the matter squarely. When the Constitution talks to specific issues and mentions expressly that we need to look at things like the youth, it is not an idle provision in the Constitution. When it talks about gender, that needs to be looked at. We thank the President and the Deputy President for observing the gender rule. No one can fault them on that. That is because six out of 16 is just good enough. In terms of gender, the Executive did excellent. The President and the Deputy President did excellent. Where someone has performed, you need to give a tick so that, when you give ticks and wrongs, finally you give marks as to whether someone has passed or failed. So, in terms of gender, I give them a tick. In terms of regional representation, they tried. We did not fail. But that one can be a tick, but when it comes to ethnicity, the President and Deputy President failed. I want to put it very clearly. The Executive is defined. The Executive under Article 132 is directed as follows:- âThe Executive must follow ethnic diversity.â I have heard a colleague say that it was not possible. Yes, it was not possible to include 42 tribes in the Cabinet, but it was possible to include 16 tribes. In fact, with a thin Cabinet like that, if you are fair, the community that produces the President should only produce a maximum of one. A community that produces the Deputy President should produce a maximum of one. When you have the Executive that we have given--- I hope the President will remember to bring the name of Kimemia to this House as the Secretary to the Cabinet. Under Article 154, we must vet him. In fact, very soon, we will start asking whether he is acting in that office constitutionally. Let him bring that name tomorrow, so that we can start vetting him. But the Cabinet we have today is composed of 20 people---"
