"content": "Hon. Speaker, Sir, I want to thank you. I want the hon. Member to read Standing Order No.89; it is on matters of sub judice or secret talks about evidence to be provided. Because I do not have any evidence to that, the Standing Orders allow me to read the Statement; the Speaker has made the clarification. Clause 20(1) of the contract of Tom Odongo stipulates that this contract may be terminated by either party giving a three months prior notice or on payment of an equivalent of three months pensionable pay in lieu of such notice by either party. If Mr. Tom Odongo wanted to leave the NSSF, he would use Clause 20(1). I am sure the Cabinet Secretary used this clause. The contract was signed between the MT and the then Minister for Labour in 2012. Mr. Tom Odongo appended his signature on the said contract on 29th November, 2012. Secondly, there was a specific breach of the contract that led to his dismissal; the Cabinet Secretary invoked clause 20 of the contract, which provided for an exit as follows: âThis contract may be terminated by either party giving a three months prior notice or on payment of an equivalent of three months pensionable pay in lieu of such noticeâ. This is from the Cabinet Secretary for Labour. No reason is needed to be assigned for terminating the contract under this clause. I have attached here the terms and conditions of the service of the MT, which were signed by Tom Odongo in the presence of the former Minister for Labour, now the great Senator of Turkana County, hon. Munyes. Finally, the Board of the NSSF has ratified the decision of the Cabinet Secretary. I beg to table this Statement."
