Chepkonga is correct in the sense that the Constitution has fixed the presumption of guilty, but I think he needs to couch his amendment properly. If the amendment says “in any proceedings” then you still do not get where you want to go. I think what he is talking about is “civil proceedings arising out of this Act”. I think he needs to couch it that way because only criminal proceedings are underpinned by the Constitution.
