Chepkonga is correct in the sense that the Constitution has fixed the presumption of guilty, but I think he needs to couch his amendment properly. If the amendment says “in any proceedings” then you still do not get where you want to go. I think what he is talking about is “civil proceedings arising out of this Act”. I think he needs to couch it that way because only criminal proceedings are underpinned by the Constitution. Civil proceedings are not underpinned by the Constitution and sometimes The electronic version of the Official Hansard Report is for information purposesonly.
