"content": "community. In the last financial year, the company spent Kshs280 million, which is equivalent to about 4.5 per cent of its annual revenue, on community support activities. The company remits Value Added Tax (VAT) to the Kenya Revenue Authority (KRA) as required by law but the Authority has failed to refund over Kshs1,440,530,729, being the amount due in tax rebate, thereby creating a serious cash flow crisis in the company which is impacting negatively on its operations. Although the KRA has disputed part of the amount, there is an undisputed figure of Kshs742,815,181 which is long overdue for refund. Tata Chemicals has held several meetings with KRA to resolve the matter and also the KRA has visited the company and carried out an audit where it agrees that it owes Tata Chemicals an undisputed refund but has made no effort to make payments. The matter is in respect of which this petition is made is not pending before any court of law or constitutional legal body. Therefore, your humble petitioner prays that the Senate of the Republic of Kenya, calls upon the KRA to refund Tata Chemicals the undisputed figure of Kshs742,815,181 to enable the company stabilize its operations and continue with its corporate-social responsibility activities which remain crucial to the local community. Mr. Speaker, Sir, the second prayer calls upon the KRA to confirm audit findings on the disputed amounts with a view to resolving the refund claim as appropriate. REPAIR OF MAGADI ROAD Mr. Speaker, Sir, that was the first petition, the second one is a petition made on behalf of Eng. Jackson Muchira Mbui. On behalf of the petitioner who is the managing director of Tata Chemicals, I wish to present the following petition to the Senate. The undersigned being the managing director of Tata Chemicals, Magadi Limited, draws the attention of the Senate to the following: THAT, Tata Chemicals Magadi Limited, East Africa, is the largest soda ash manufacturer and one of Kenya’s leading exporters. The company is an important part of the socio-economic fabric of Kajiado County where the soda ash facility is based. The company is an equal opportunity employer with over 1000 employees and has established numerous successful initiatives focusing on education, health, water, employment and infrastructure for the benefit of the local community. The company owns and runs a 146 kilometre railway line stretching from Magadi to Konza. It also constructed Magadi Road which it handed over to the Government of Kenya. Following the last long rains, Magadi Road was extensively damaged and a number of bridges destroyed. The Government appointed a contractor to repair the road and bridges but the contractor has not completed the work owing to non-payment of his dues. Tata Chemicals has held several meetings with the Kenya National Highways Authority (KeNHA) and the contractor but the road and bridges continue to deteriorate and the work is far from complete. The onset of the expected short rains will make the road inaccessible disrupting the business of the company and movement of communities in Magadi who depend on the road for movement from one point to another.
