    "content": "Thirdly, Sen. Murungi wanted to know the criteria used by the Government to extend the 99 year leases after they have expired. Lessees should apply for extension of lease before the expiration of the term. This forestalls a situation where the land reverts back to the Government and where any other Kenyan can be considered for allocation of the land. However, this notwithstanding, the Government policy is to extend leases to the persons owning the land on application of the same subject to: (a) Proof that the land is registered to the applicant. (b) Proof that the land is developed for the purpose that it was allocated for or is sustainably used. It is important to note that lack of development is a strong reason to reject extension of lease. (c) Proof that the property has recently been redeveloped or renovated or is in good condition that necessitates continued use of the lease. (d) The capacity of the lessee to redevelop the property in line with the zoning of the locality the land is situated. (e) Proof that the lessee has been paying rents and rates and observing other conditions as stated in the grant or the lease document as part of the contract between the lessee and the Government. (f) Proof that the developments are not encroaching on any public purpose land. (g) The lessee’s willingness to comply with the planning requirement that will call for surrender of part of the land for road widening and other development.
