That determination should be elsewhere but, as you know, this is clearly provided for also in Section 39 of the Political Parties Act; the establishment of the Political Parties Disputes Tribunal and its functions are well spelt out in Section 40. They include, among other things, resolving disputes of this nature. So, I would advise parties that feel that they want to have a test case on this one to kindly take a walk to the PPDT and see how it is going to be resolved.
