"content": " On a point of order, Mr. Temporary Deputy Speaker, Sir. I stand under Standing Order No.47(3) which says: âIf the Speaker is of the opinion that (a) that the proposed Motion is contrary to the Constitution without expressively proposing appropriate amendments of the Constitution; or is too long; or is framed in terms which are inconsistent `with the dignity of the House; or contains or implies allegation which the Speaker is not satisfied that the Mover can substantiate; or calls for the commitment of public funds for which no provision is made in the Annual Estimates as adopted by the National Assembly, the Speaker may direct either that the Motion is inadmissible, or that notice of it cannot be given without such alternation as the Speaker may approve.â Mr. Temporary Deputy Speaker, Sir, I say this because I have cited a number of articles in this Constitution that this Motion negates and violates. I think it is high time that this House should not for now and even in the future pass a Motion, or any piece of legislation that is contrary to the Constitution. If you look at Article 7(1)(2)(3), and I will read out (3); it states: âThe state shall promote and protect the diversity of languages of the people of Kenya. The state shall also promote the development and use of indigenous languages, Kenyan Sign language, Braille and other communication formats and technologies accessible to persons with disabilities.â Article 11(2) states that the State shall promote all forms of national and cultural expression through literature, art, language and communication. This is the basis of the heritage under language. Article 27(4), which is on equality and the freedom from discrimination says; âThe State shall not discriminate directly or indirectly against any person based on a number of issuesâ. I will pick on ethnicity and we know that the basis and hallmark of an ethnic community is the language. Article 28 of the Constitution on human dignity says that every person has inherent dignity and the right to have that dignity respected and protected. The language of any community is a dignity that must be protected."
