The method of procuring the contract used is provided for in Section 6(1) of the Public Procurement and Disposal Act, 2005, which states that:- “Where any provision of this Act conflicts with any other obligation of the Republic of Kenya, arising from treaty or other agreement to which Kenya is a party, this Act shall prevail except in the instance of negotiated loans or grants”."
