Speaker, there was also a memo written in April, 2012 which was a Cabinet decision communicated and granted approval for the Government-to-Government arrangement for implementation of the project. The Director-General, Public Procurement and Oversight Authority (PPOA) indicated to the Committee that the procurement entity, that is Kenya Railways Corporation--- The Standard Gauge Railway (SGR) project was a Government-to-Government project, which is to be funded by a negotiated loan; it was, therefore, exempted from the application of the Public Procurement and Disposal Act, 2005, pursuant to Section 61 of the Act."
