"content": "The business before us is the National Flag, Emblems and Names (Amendment) Bill, 2013. If you look at the Constitution, under Article 9(1), you will see that the national symbols of the Republic are given as the national flag, the national anthem, the coat of arms and the public seal. Article 10 of our Constitution is about national values and principles of governance. One of the values provided under Article 10(2)(a) is patriotism. One of the proposed amendments says that the national flag is supposed to promote patriotism. That is where I have a fundamental problem. Under the proposed Clause 4A(1), the Bill says that a person shall not fly the national flag on any motor vehicle. Under Sub-clause (3) of the same proposed Clause 4A, the Bill provides that a person who contravenes Sub-section (1) commits an offence and shall be liable, on conviction, to a fine not exceeding Kshs.1 million or imprisonment for a term not exceeding five years or both.
