Gross violation is seen as a fragrant violation, glaring error, severe transgression of the Constitution or the law. Indeed, the matter was also canvassed in Wambora’s case, where the High Court, sitting at Kerugoya, said that what constitutes gross violation depends on the facts of each case, and not every violation of the Constitution or the law can lead to a removal of a Governor. The allegation has to be serious, substantial and weighty."
