Mbadi is the legal basis for the appointment of the Director and the Deputy Director and the justification given by the Minister is that the appointments were not substantive and were in an acting capacity to ensure normal operations within the department were not disrupted. Substantive appointments thereafter will actually be done by the PSC. That was the position given by the Cabinet Secretary on the question of the legal basis of the appointments."
