Members, the petitioner claims that the said members of the JSC have violated the Constitution by breaching one, Article 161(2)(c) that designates the Chief Registrar of the Judiciary as the Accounting Officer of the Judiciary by purporting to approve and/or disapprove expenditure of monies allocated to the Judiciary, thereby causing inordinate delay in the processing of salaries for judicial staff; two, Article 173(1)(3) that designates the Chief Registrar of the Judiciary as the administrator of the Judiciary funds and directing payments to be done by persons not authorised to approve expenditure, thereby increasing the vulnerability of the Judiciary and three, Article 245(4) of the Constitution, which provides that no person may give directions to the Inspector-General with respect to the investigations of any particular offences. The said members of the JSC signed a resolution directing the police not to arrest and charge Judiciary staff who are alleged to have stolen Kshs80 million from the Judiciary, thereby willfully interfering with criminal investigations.
