(a)The Miscellaneous Civil Application No.673 of 2005 in the High Court of Kenya sitting at Nairobi in which Joseph Mburu and others filed contempt proceedings against the Commissioner of Police and others on two occasions were dismissed; one on a technicality and the other was stood over generally to await determination of an appeal filed in the Court of Appeal and conclusion of the criminal cases pending before court. It is worth noting here that no injunction was issued vide this Miscellaneous Civil Application which I wish to table."
