"content": "Mr. Chairman, Sir, I stand to support the amendment on the amendment that was moved by Sen. (Dr.) Khalwale. I think he cited Article 216 of the Constitution. Indeed, the amendment brought by Sen. Mutula Kilonzo Jnr., as it was, contravened the provisions of Article 216. I just want to bring it to the attention of Members who may not know, that even if we went ahead and passed that particular amendment as it was brought, somebody could have challenged this. This is under Article 2(4), the supremacy of this Constitution which states:- “Any law, including customary law, that is inconsistent with this Constitution is void to the extent of the inconsistency, and any act or omission in contravention of this Constitution is invalid.” So, indeed, that amendment would have been invalid even if we passed it the way it was. So, I want to thank Sen. (Dr.) Khalwale for that amendment."
