"content": "We have a short Communication regarding Order No. 9. You will recall that on October 30, 2014, the House commenced deliberations on the Presidential Memorandum on the Statute Law (Miscellaneous Amendments) Bill, 2014 on provisions relating to Cap.2 Laws of Kenya (Interpretation and General Provisions). At the time of reporting progress, the provisions relating to the Anti-Corruption and Economic Crimes Act had not been concluded. Debate will therefore commence from the proposed amendments to the Act. Honourable Members, it is also important to note the concerns by hon. Members that, by deleting the words “executive authority” under section 62(1A) of Anti- Corruption and Economic Crimes Act, 2003, hon. Members of Parliament to be subject to the provisions relating to suspension of a person from office on grounds of a charge under that law. This matter was deliberated on at length in the House Business Committee and it was noted that Section 62 (6) provides for the procedure to be used in relation to specific office holders. This section states and I quote:- “This section does not apply with respect to an office if the Constitution limits or provides for the grounds upon which a holder of the office may be removed or the circumstances in which that office must be vacated,” This is, therefore, to allay hon. Members’ fears that the removal of the words ‘executive authority’ will expose them to the provisions of the law relating to removal from office upon a charge. I thank you."
