"content": "This Standing Order was meant to operationalise the provisions of Article 110(3) of the Constitution, which provides that:- “Before either House considers a Bill, the Speakers of the National Assembly and the Senate shall jointly resolve any question as to whether it is a Bill concerning counties and, if it is, whether it is a special or an ordinary Bill.” As we are aware, from the Memorandum of Objects and Reasons, the Mining Bill, 2014, sponsored by the Leader of Majority Party and the National Drought Management Authority Bill, 2013 sponsored by the Member for North Horr, hon. Chachu Ganya, were at the point of publication and subsequent First Reading, determined to be “Bills not concerning county governments,” for the purpose of Article 110 (2) of the Constitution. Hon. Members, I have, however, perused the Mining Bill, 2014, as passed by the House on 29th October, 2014 and found that some of the Committee Stage amendments proposed by the Committee on Environment and Natural Resources and adopted by the House had the effect of converting the Bill into “a Bill concerning county government”. In this respect, the Committee proposed and this House adopted, amendments to provide for the regulation of artisanal mines and established in every county, an Artisanal Mining Committee. In the composition of the Artisanal Mining Committee, the governor is expected to nominate a representative, who shall also be the chairperson of the committee. Additionally, the Committee on Environment and Natural Resources proposed, and this House adopted, a formula for sharing of royalties as follows:- (a) seventy per cent to the national Government; (b) twenty per cent to the county government; and"
