    "content": "Hon. Members, you will recall that yesterday, during the afternoon Sitting, the Member for Gem, hon. Jakoyo Midiwo, on a point of order, sought the guidance of the Speaker on the issue of whether the Member for Kajiado Central, hon. Joseph Nkaissery, ought to have resigned prior to the conveyance of the Message from His Excellency the President, nominating him for appointment as the Cabinet Secretary, Ministry of Interior and Coordination of National Government. Having perused through the Verbatim Report for the afternoon Sitting, I must thank the hon. Member for raising this matter, which has implications on the interpretation of the Constitution. In summary, the hon. Member sought guidance on whether a person ceases to be a Member of the House upon being nominated for appointment as a Cabinet Secretary. To begin with, this is the first time this House is faced with a scenario where a sitting Member of Parliament has been nominated for appointment as a Cabinet Secretary, under the current Constitution. I note that the Constitution, in Article 103(1), provides as follows:- “103(1) The office of a member of Parliament becomes vacant- (a) if the member dies; (b) if, during any session of Parliament, the member is absent from eight sittings of the relevant house without permission, in writing, from the Speaker and is unable to offer a satisfactory explanation for the absence to the relevant committee; (c) if the member is otherwise removed from office under this Constitution or legislation enacted under Article 80; (d) if the member resigns from Parliament in writing to the speaker; (e) if, having been elected to parliament- The electronic version of the Official Hansard Report is for information purposesonly.
