Members, a plain reading of the above provisions reveals that nomination for appointment as a Cabinet Secretary is not one of the matters contemplated under the Constitution as necessitating the vacation of the office of a Member of Parliament. As I noted yesterday, I am yet to receive a letter of resignation from the hon. Member for Kajiado Central. As per Article 152 of the Constitution, the position of the Member for Kajiado Central shall only become untenable if he elects to assume the office of a Cabinet Secretary in the event that this House approves his nomination. Article 152 (3) and (4) provide as follows:- “152(3) A cabinet secretary shall not be a member of parliament; (4) Each person appointed as a Cabinet Secretary- (a) assumes office by swearing or affirming faithfulness to the people and the Republic of Kenya and obedience to this Constitution, before the President and in accordance with the Third Schedule; and, (b) may resign by delivering a written statement of resignation to the president.”"
