"content": "Hon. Senators, I note that Sen. (Dr.) Khalwale also undertook to lay in the Senate, reports on the audit reports that the Committee had worked on before the injunctions issued by the courts. As the Senator observed, the work of the Committee has been interrupted by a process of the law. Consequently, the timelines stipulated in the Constitution would, for the duration of the injunctions, freeze and cease to run. At the appropriate time, the Committee would then discharge its mandate and to table its reports. But that does not stop you from interrogating them. However, it is apparent that the relationship between the arms of Government and, in particular, the Legislature and the Judiciary must be such that the actions of one arm do not impede another arm of Government in the execution of its mandate. The prevailing injunctions issued by the courts have, unfortunately, in many respects stalled the execution of the mandate of the CPAIC. This further adversely affects the execution of the oversight mandate of the Senate as a whole under Article 96(3) of the Constitution. I, therefore, wish to call upon the Judiciary – and, indeed, any other arm of Government – to ensure that these matters are expeditiously heard and concluded so as to ensure that the Legislature discharges its constitutional mandate without any fetters because injunctions are supposed to be temporary, but they seem to be taking much longer than even the process of Parliament would have taken.
