"content": "I am reading section Clause 83. It says: “The head of procurement function of a procuring entity shall, alongside to the report to the evaluation committee as secretariat comments, review the tender evaluation report and provide a signed professional opinion to the accounting officer on the procurement or asset disposal proceedings.” Unless we limit the bounds and the extent to which this opinion is to be given, it is very probable that this opinion could easily override any recommendations made by the evaluation committee. This is something that must be avoided. We cannot leave room to an opinion of a head of procurement function to override what possibly might have been decided or done by the evaluation committee. I will be moving amendments to ensure that this happens. In most public functions there is always a risk of regulatory capture. We have in this particular Bill created so many institutions that you wonder whether there will not be duplication of roles and functions. The one that worries me most is the Procurement Regulatory Authority. It could easily be “ kaput” if the functions given to it are not performed.
