Members, you will recall that yesterday I issued guidance on the manner of considering amendments to the Retirement Benefits (Deputy President and Designated State Officers) Bill, 2013 in terms of Article 114 of the Constitution. My attention has been drawn to the further amendments proposed by the Chairperson of the Finance, Planning and Trade Committee, which are listed on today’s Order Paper. A scrutiny of the amendments reveals that the Finance, Planning and Trade Committee is proposing to include a retired Chief Justice as one of the beneficiaries to the proposed entitlements. Following the recommendations of the Budget and Appropriations Committee, any inclusion of an office other that one recommended by the Budget Committee would offend the provisions of Article 114 of the Constitution as it would entail an additional charge on the Exchequer. That amendment to Clause 2, therefore, will not be considered in the Committee of the whole House. The Finance, Planning and Trade Committee is also proposing amendments relating to the use of the words “a retired designated State officer”.
