"content": "Hon. Temporary Deputy Chairman, first of all, let me thank the Chairman of the Committee for requesting that we defer consideration of this one. Would I be in order to request that as we consider this matter, we also consider possible constitutional conflicts? If you allow me, I will take you through. If you look at the Memorandum from His Excellency the President, it deals mainly with the provision--- Under Clauses 4 and 8 he is referring to Article 234(5) of the Constitution on the Public Service Commission (PSC). If you just indulge me, I will read. “The Commission may delegate, in writing, with or without conditions, any of its functions and powers under this Article to any one or more of its members, or to any officer, body or authority in the public service.” You go to Article 252 (c) of the Constitution on general functions and powers of independent offices. It says the following:- “Each Commission, and each holder of an independent office— (c) shall recruit its own staff.” The electronic version of the Official Hansard Report is for information purposesonly.
