Speaker, I beg to move the following Special Motion:- THAT, pursuant to the provisions of Article 152(5)(c),(6) and (7) of the Constitution and Standing Order No.61 and No.66 of the National Assembly Standing Orders, this House resolves that the President dismisses Prof. Jacob Thuranira Kaimenyi as the Cabinet Secretary for Education, Science and Technology on the following grounds:- (a) Gross violation of the provisions of the Constitution of Kenya and other laws; and, (b) Gross misconduct. The particulars upon which this Motion is made are set out as follows:- A. Gross violation of the provisions of the Constitution of Kenya and other laws:- (i) THAT, the Cabinet Secretary has failed to embrace public participation in drafting and publication of the Basic Education Regulations 2015, contrary to Article 10(2) as well as disregarding the mandatory procedural requirement of Article 261(4) of the Constitution of Kenya which requires the Cabinet Secretary to subject the Basic Education Regulations 2015 to review by the Commission for Implementation of the Constitution (CIC), the Attorney General and Kenya Law Reform Commission (KLRC) before publication in the Kenya Gazette; (ii) THAT, the Cabinet Secretary has breached Section 6 of the Education Act No.7 of 2007 by permitting many educational institutions to operate without boards of management; The electronic version of the Official Hansard Report is for information purposesonly.
